HoopArc Terms of Service

Effective Date: August 26, 2026

These Terms of Service (“Terms”) govern your access to and use of the HoopArc mobile application, website, and related services (collectively, the “Service”).

HoopArc is operated by Vladan Markovic, an individual based in Bosnia and Herzegovina (“HoopArc,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. About HoopArc

HoopArc is a basketball progression and career-tracking application.

The Service allows users to record and manage information such as:

• basketball Training;
• Games and statistics;
• pre-game mindset entries;
• post-game reflections;
• Weekly Reviews;
• player ratings and progression;
• XP, levels, Missions, streaks, and Development Points;
• optional player photos;
• Player Cards;
• reminders and related basketball-development information.

HoopArc is intended to be a personal tracking, organization, and motivational tool.

It is not a professional scouting, medical, recruitment, coaching, or athletic-certification service.

2. Eligibility and Minors

HoopArc is a general-audience application and is not directed to children under 13.

If you are under the age at which you can legally agree to these Terms on your own where you live, you may use HoopArc only with the authorization of a parent or legal guardian where required by applicable law.

If applicable law requires parental or guardian consent for your use of the Service or for the processing of your personal information, you may use HoopArc only after the required consent has been obtained.

You may not use the Service where doing so would violate applicable law.

3. Your Account

HoopArc currently uses Sign in with Apple and Supabase Authentication.

You are responsible for:

• maintaining control of your Apple account and device;
• protecting access to your device;
• providing accurate information where reasonably required;
• not impersonating another person;
• notifying us if you reasonably believe your HoopArc account has been compromised.

You may not create or use an account for fraudulent, abusive, deceptive, or unlawful purposes.

4. Premium Subscriptions

Some or all protected HoopArc functionality may require an active paid subscription.

Subscriptions are offered through the Apple App Store.

HoopArc uses RevenueCat to help verify purchases, restoration, subscription state, and premium entitlement.

Prices, billing periods, applicable taxes, trial or introductory-offer terms, if any, and other purchase details are shown by Apple at or before purchase.

Automatic Renewal

Where the subscription you select is auto-renewable, it will continue to renew according to the terms shown by Apple unless cancelled in accordance with Apple's subscription-management rules.

Apple manages charging and billing.

Managing or Cancelling Your Subscription

You can manage or cancel your subscription through your Apple account/App Store subscription settings.

Deleting:

• your HoopArc account; or
• the HoopArc application from your device

does not automatically cancel your App Store subscription.

If you do not want the subscription to renew, you must manage it separately through Apple.

Restore Purchases

HoopArc provides purchase-restoration functionality for eligible App Store purchases.

Restoration depends on Apple, RevenueCat, the Apple account associated with the purchase, and valid subscription entitlement.

Refunds

Apple processes payments and generally handles App Store refund requests according to Apple's policies and applicable law.

HoopArc does not directly receive your full payment-card details.

Nothing in these Terms limits any refund, cancellation, withdrawal, or consumer right that applicable law does not permit you to waive.

5. HoopArc Progression and Ratings

HoopArc may calculate or display:

• skill ratings;
• mentality ratings;
• OVR;
• archetype;
• XP;
• level;
• streak;
• Development Points;
• Missions;
• Current Focus;
• progression history.

These values are part of HoopArc's own motivational and progression system.

They are not:

• professional scouting evaluations;
• official player rankings;
• certified assessments of athletic ability;
• medical assessments;
• professional coaching evaluations;
• guarantees of future performance.

Do not rely on a HoopArc rating as the sole basis for an important athletic, medical, educational, recruitment, scholarship, contractual, or career decision.

6. Physical Activity and Health

Basketball, Training, and competition involve physical activity and potential risk of injury.

HoopArc does not provide:

• medical advice;
• diagnosis;
• treatment;
• rehabilitation advice;
• emergency services;
• individualized professional medical or coaching supervision.

You remain responsible for deciding whether a particular activity is appropriate for you.

Where appropriate, follow guidance from qualified coaches, trainers, healthcare professionals, parents, guardians, or other responsible professionals.

If you experience injury, pain, illness, dizziness, or another health concern, stop the relevant activity and seek appropriate assistance.

7. Content You Provide

You may provide content including:

• player name;
• optional player photo;
• basketball Training information;
• Game information;
• notes;
• mindset entries;
• reflections;
• Weekly Reviews;
• other information you choose to enter into HoopArc.

You retain ownership of content that belongs to you.

You grant HoopArc a limited, non-exclusive right to host, store, process, reproduce, and display your content only as reasonably necessary to:

• provide the Service;
• maintain your account;
• synchronize your data;
• calculate progression;
• generate your Player Card;
• provide sharing you request;
• maintain security and reliability;
• meet applicable legal obligations.

This permission does not give HoopArc ownership of your personal content.

The permission ends when the relevant content is deleted, except to the limited extent temporary backups, technical records, provider retention, security requirements, or applicable law require continued retention.

8. Your Responsibilities for Content

You are responsible for content you provide.

You must not knowingly upload or submit content that:

• you do not have the right to use;
• unlawfully infringes another person's rights;
• is fraudulent or intentionally deceptive;
• contains malicious code;
• is illegal to possess, upload, or process;
• is submitted for the purpose of abusing or attacking the Service.

Free-text fields are intended for basketball-related information. Do not intentionally submit sensitive information that is unnecessary for using HoopArc.

9. Player Photos

Player photos are optional.

If you choose to provide a photo, you confirm that you have the right or appropriate permission to use it.

HoopArc may process, crop, resize, store, and display the photo as necessary to provide player-profile and Player Card functionality.

HoopArc does not use the player-photo feature to create a public photo gallery or public social profile.

10. Player Card Sharing

HoopArc may allow you to generate a Player Card containing information such as:

• player name;
• optional player photo;
• position;
• OVR;
• level;
• selected basketball ratings.

Sharing occurs only when you initiate it.

Once you intentionally share a Player Card with another person or third-party service, that recipient or service may store or process the shared content under its own terms and privacy practices.

HoopArc cannot control information after you voluntarily share it outside the Service.

11. Acceptable Use

You may not:

• use HoopArc for unlawful purposes;
• impersonate another person;
• attempt to access another user's account or private data;
• bypass or attempt to bypass subscription controls;
• manipulate entitlement or progression systems fraudulently;
• interfere with the Service or infrastructure;
• probe, attack, compromise, or circumvent security controls;
• introduce malware or malicious code;
• use automated systems to abuse or materially disrupt the Service;
• use HoopArc to infringe the rights of another person;
• use the Service for fraud or deceptive conduct.

Nothing in this section prevents activity that applicable law expressly permits and does not allow us to prohibit.

12. HoopArc Intellectual Property

Except for user-owned content and third-party materials, HoopArc and its associated:

• software;
• source code;
• logo;
• brand;
• interface;
• visual design;
• graphics;
• original text;
• progression systems;
• other original materials

are owned by or licensed to the operator of HoopArc and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of HoopArc intellectual property to you.

13. Apple Application License

If you download HoopArc through the Apple App Store, the license to use the iOS application is also subject to Apple's Standard Licensed Application End User License Agreement (Standard EULA) and applicable Apple Media Services terms.

These HoopArc Terms govern your relationship with HoopArc regarding the Service, accounts, subscriptions, content, and HoopArc-specific functionality.

They are not intended to replace Apple's Standard EULA.

If an applicable Apple term and these Terms address different subjects, each applies to its respective subject matter. If mandatory law requires a different result, mandatory law controls.

14. Third-Party Services

HoopArc depends on third-party services including:

• Apple;
• Supabase;
• RevenueCat.

Your use of related functionality may also be subject to applicable third-party terms and policies.

We are not responsible for third-party outages, platform changes, account restrictions, or service failures that are outside our reasonable control.

15. Notifications

HoopArc may provide optional local notifications or reminders for features such as Missions or Weekly Reviews.

Notifications can be disabled through your iOS settings and, where available, HoopArc preferences.

Notification delivery cannot be guaranteed because it may depend on device settings and operating-system behavior.

16. Service Availability and Updates

We aim to provide a reliable Service, but we do not guarantee uninterrupted or error-free availability.

We may reasonably:

• correct bugs;
• update the app;
• improve or change features;
• change progression mechanics;
• add or remove functionality;
• perform maintenance;
• take steps required for security or legal compliance.

We may discontinue part or all of the Service where reasonably necessary, subject to applicable consumer law.

17. Account Deletion

HoopArc provides an in-app account-deletion process.

Account deletion is designed to remove HoopArc-controlled player data associated with your account, including private player photos and player-owned application records, subject to limited technical, security, backup, provider, and legal retention requirements.

Deleting your HoopArc account does not necessarily delete information maintained independently by Apple or RevenueCat.

Deleting your HoopArc account does not automatically cancel your App Store subscription.

If you no longer want a subscription to renew, manage it separately through Apple.

18. Suspension and Termination

You may stop using HoopArc at any time.

We may restrict, suspend, or terminate access where reasonably necessary because of:

• serious or repeated violation of these Terms;
• fraud;
• attempted subscription bypass;
• unauthorized system access;
• material security threats;
• abusive use;
• unlawful activity;
• applicable legal requirements.

Where reasonably appropriate, we may provide notice.

Nothing in this section limits mandatory consumer rights.

19. Privacy

Use of HoopArc is subject to the HoopArc Privacy Policy, available at:

https://hooparc.app/privacy

The Privacy Policy explains how personal information is collected, processed, stored, shared, and deleted.

20. No Guarantee of Basketball Results

HoopArc helps users record and visualize basketball development.

We do not promise or guarantee:

• improvement in basketball ability;
• specific skill gains;
• increased playing time;
• team selection;
• recruitment;
• scholarships;
• contracts;
• professional basketball opportunities;
• financial results;
• particular physical or fitness outcomes.

Basketball development depends on many factors outside HoopArc's control.

21. Disclaimers

To the maximum extent permitted by applicable law, HoopArc is provided on an “as available” basis.

We do not guarantee that:

• HoopArc will always be available;
• every feature will always operate without error;
• every displayed rating will perfectly represent real-world basketball ability;
• third-party infrastructure will always remain available;
• all unsynchronized local information can be recovered under every possible device or network failure.

Nothing in these Terms excludes a warranty, guarantee, or other legal protection that applicable law does not allow us to exclude.

22. Limitation of Liability

To the maximum extent permitted by applicable law, HoopArc and its operator will not be liable for indirect, incidental, special, consequential, or similar losses arising from use of or inability to use the Service.

This may include, where legally permitted, losses arising from:

• temporary loss of Service access;
• third-party outages;
• loss of an opportunity;
• voluntary external sharing;
• reliance on HoopArc progression values as professional evaluations.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

This section does not limit liability for fraud, intentional misconduct, or any other liability that legally cannot be excluded or limited.

23. Consumer Rights

You may have mandatory rights under the laws of the country where you live.

These Terms do not remove rights that applicable consumer law does not permit you to waive.

If a provision of these Terms conflicts with a mandatory consumer-protection rule that applies to you, the mandatory rule controls to the extent required.

24. Governing Law and Disputes

These Terms are governed by the laws applicable in Bosnia and Herzegovina, without giving effect to conflict-of-law rules that would defeat mandatory protections applicable to you.

This choice of law does not deprive you of mandatory consumer rights available under the laws of your country of residence.

Disputes will be handled by a court of competent jurisdiction, subject to any mandatory right you may have to bring or defend a claim in another jurisdiction.

25. Changes to These Terms

We may update these Terms as HoopArc, its features, service providers, or legal requirements change.

If changes are material, we may provide notice through the app, website, or another reasonable method.

The current version will display its effective date.

Where applicable law requires additional consent to a material change, we will seek it before applying that change as required.

26. Severability

If a provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.

27. Entire Agreement

These Terms and the HoopArc Privacy Policy constitute the agreement governing your relationship with HoopArc concerning HoopArc-specific services, accounts, content, and functionality, together with any applicable purchase terms shown by Apple.

The Apple Standard EULA separately governs the license to the iOS application where applicable.
